FAV Lawyer’s response to VMT/Orcem’s appeal of Staff Determination

On February 7, City Hall officially opposed VMT/Orcem project.

On February 8, the project applicants challenged the staff recommendation to halt the CEQA process and deny the VMT/Orcem permit; they also had their lawyer send a letter. On February 22, FAV was able to obtain these documents through a public documents request, see Appeal of Staff Determination Refusing to Certify EIR for Consideration of Orcem & VMT Projects.pdf. 

Today, Fresh Air Vallejo’s attorney officially sent a letter of support to the Mayor, Council, Planning Commission and City Staff, stating that, “The City’s exercise of authority in this regard is procedurally and substantively proper, and sound public policy in furtherance of public and environmental health…”

That the VMT/Orcem applicant’s letters “are both procedurally and substantively erroneous, and should be rejected.”
